By signing up with AMERICA'S SCORECARD, LLC, the undersigned, for itself, and on behalf of its members, participants, etc., in consideration for the use of the website of AMERICA'S SCORECARD, LLC, hereby waives and releases AMERICA'S SCORECARD, LLC, its members, principals, employees, etc., from any and all liability with respect to the services to be performed.

AMERICA'S SCORECARD, LLC shall not be liable for any error in the listing of or presentation of data, results, standings, etc., or for any failure, temporary or permanent, of its website.

AMERICA'S SCORECARD, LLC shall not be responsible or liable for any event beyond its control and its performance in such event(s) shall be excused by the undersigned.

AMERICA'S SCORECARD, LLC shall not be liable for any consequential damages. No refunds are permitted. Damages shall be limited to a maximum of ONE-HUNDRED ($100.00) DOLLARS.

The undersigned hereby releases, waives, discharges and covenants not to sue AMERICA.S SCORECARD, LLC, its members, principals, employees, etc., for any and all liability and/or damage and/or loss, and such release, waiver, discharge and covenant not to sue is intended to be as broad and inclusive as is permitted by law.

The undersigned hereby agrees and acknowledges that this Waiver/Release of liability shall be construed in accordance with the laws of the State of New Jersey and any and all actions shall be brought in the Superior Court of New Jersey.

In the event that any portion of this Waiver/Release is held invalid, the remaining terms shall continue in full force and effect; and

By my agreement, I, on behalf of myself and any person or entity I represent, certify that I have read and reviewed this Waiver and Release of Liability, that I understand its terms and provisions, that I have had the opportunity to investigate its content and to consult with an attorney, if desired, and that this Waiver and Release contains legal consequences to me and that I am giving up and surrendering substantial rights by agreeing to same, and by my agreeing voluntarily accept all risks as set forth herein and accept all Waiver and Release provisions herein.
